How To Find Recent Arrests in Volusia County Florida for Free

In Volusia County, the Division of Corrections maintains the county jails, rather than the Sheriff’s Office (unlike in many other counties across the U.S.).

That makes the Division of Corrections the first place to check when trying to locate jail records. However, it’s also worth contacting the Sheriff’s Office, as well as other local law enforcement agencies, when trying to track down Volusia County arrest records.

The Volusia County Division of Corrections maintains two jails: the Branch Jail and the Correctional Facility.

The Branch Jail houses male inmates currently awaiting trial, as well as those who have been sentenced by the Circuit Court for committing a felony. On the other hand, the Correctional Facility houses all female inmates (both pre- and post-trial), as well as male convicts who have been sentenced by the County Court for committing a misdemeanor.

It’s possible to view both current and past inmates of the Branch Jail and the Correctional Facility by using the Division of Corrections’ Inmate Information Search tool.1 This tool allows you to search inmates by entering just a last name. Or you can leave the search fields blank to see a complete list of current inmates.

For each person included in the public index of inmates, you can view their charges, bail information, description, and booking photo. This makes the search tool the most efficient way to find someone’s mugshot.

By default, the search results are listed in alphabetical order by last name. However, by selecting the “Recent” button, you can view the latest additions to the jail roster first.

In addition, it’s possible to download daily arrest and booking logs through the Volusia County Clerk of Circuit Court’s website.2 These logs are spreadsheets that contain the names, dates of birth, and charges for every person arrested in a single day. Typically, these logs are available for download on the site for about two weeks before they’re removed.

Look Up Arrests & Obtain Police Reports Through Local Law Enforcement Agencies in Volusia County

If the Division of Corrections isn’t able to provide you with the information you’re seeking, it’s also possible to locate Volusia County arrest records by directly contacting the Sheriff’s Office and the other law enforcement agencies within the county.3

The Sheriff’s Office posts Activity Reports to its website every weekday afternoon. (Weekend reports are posted on Mondays.) You can use these reports to find out more information about the previous day’s arrests, as well as other criminal activity in the county.

In addition, you can order a copy of an official police report after three business days following the incident in question. The cost is $0.15 per page for single-sided black-and-white copies and $0.20 per page for black-and-white double-sided copies.

Color copies cost $0.25 per page for single-sided and $0.35 per page for double-sided. You can submit your record request online by using the Sheriff’s Office Public Records Portal. There’s even an option to make an anonymous records request.

How To View Volusia County Florida Criminal Cases

You can also execute a free criminal record check by looking up Volusia County court records and records having to do with warrants and probation sentences.

The best place to start is with the Volusia County Clerk’s Office. However, other agencies may maintain the records you’re looking for.

Locate Criminal Records in Volusia County Florida via the Clerk of the Circuit Court

The Clerk of the Circuit Court maintains all records pertaining to criminal court cases tried in Volusia County. That includes cases tried by the Circuit Court (felonies) or the County Court’s criminal division (misdemeanors).

You can search criminal court records online by using the office’s Case Management System.5 You can use this resource to search for cases by number or by party name. You can narrow down the search to Volusia County criminal records by selecting “Felony” or “Misdemeanor” from the “Case Type” drop-down menu.

Once you’ve entered your search criteria, you’ll see a list of cases that match. If you select one of the line items, you’ll have the opportunity to view details about the case, including a list of every court date, charge, and involved party.

If you select the “Docket” tab, you’ll see an online directory of documents related to the case. Documents that have a yellow or green “Page” icon are viewable — you can simply click on the icon. You’ll then be able to download or print the document in question.

Documents marked with the red “Page” icon can be requested from the Clerk’s office. However, you’ll first need to register for an account before you can view the document. Registering for an account involves completing the Online Viewing Agreement and having it notarized.6

How To Perform a Warrant Search in Volusia County Florida

The first place to check to see if you or someone you know has an open warrant is by contacting the Volusia County Sheriff’s Office. The office has a Warrants Unit that can be called at 386-736-5962.

Here’s an important caveat: If you have an open warrant and visit the Sheriff’s Office — or any other law enforcement agency in Volusia County — you’ll likely be arrested on the spot.

How To Find Volusia County Probation Records

If you want to find out if someone is on probation — that is, serving out a sentence at home or in the community rather than being incarcerated in jail — there are two options. The first option is to use the Clerk of the Circuit Court’s Case Management System.

This service allows you to look up offenders by name. See the section of this resource on looking up court case information for more details. If the offender was given a sentence of probation, this information will appear in the “Offense” tab under “Sentence.”

The other way to check for a probation sentence is by consulting the Florida Department of Corrections. This department oversees probation services for people who have been found guilty of a felony. How To Execute a Criminal Background Check in Volusia County Florida

By conducting a background check, you can find out if someone has a criminal history. You can use all of the methods for conducting a Volusia County public records search covered in this article to perform what’s considered a personal background check.

Personal background checks are those that are conducted for non-business-related reasons, such as to find out more about a potential love interest or a new neighbor. On the other hand, professional background checks are requested by businesses, nonprofits, tenants, etc., that want to look up someone’s criminal record before hiring them, allowing them to rent a property, or granting them a license.

According to the U.S. Fair Credit Reporting Act (FCRA), professional background checks require the consent of the subject before they can be undertaken.10

The Equal Employment Opportunity Commission (EEOC) and the Federal Trade Commission (FTC) are two federal agencies that can assist anyone who believes that they’ve been discriminated against due to their history or who may be the victim of an unlawful background check.

As mentioned above, you can essentially conduct a background check by using any of the search methods detailed in this article. In addition, you can also request a records check from the Volusia County Clerk of the Circuit Court.11 The office will search county criminal records for a specific year for $2 per year per name, plus $1 per page for the report.

If you wish to expand your background check beyond Volusia County’s borders, you can order one from the Florida Department of Law Enforcement (FDLE).12 This agency offers individuals two choices for a personal background check:

  1. FDLE Criminal History on the Internet (CCHInet) Check: For $25, you can look up an individual’s criminal history in the state. The FDLE will email you a report with the search results.
  2. State of Florida Criminal History Record Check: For $24, the FDLE will search its database of criminal history records and mail the results to your address.

The FDLE also offers a professional background check to authorized agencies, the Originating Agency Identification (ORI) Search.13 The cost for this professional-only search varies per agency.

How To Run a Florida Criminal Record Search Utilizing State & Federal Agencies

In addition to all of the county-level agencies listed above, you can use a variety of tools hosted by state- and federal-level agencies to check public records related to someone’s criminal history.

These search tools are listed below with a brief description of each.

How To Search Court Records in Volusia County Florida by Name

When looking for Volusia County judicial records, it helps to know how the Florida court system is set up. At the highest level is the Florida Supreme Court, followed by the district appeals courts.

There are six of these appeals courts. Volusia County is in the Fifth District Court of Appeal.16 Below these appeals courts are the trial courts, the Circuit Court and the County Court.

Volusia County is in the Seventh Judicial Circuit of Florida, along with Flagler, Putnam, and St. Johns counties. The Circuit Court tries cases involving civil disputes with claims worth more than $50,000, felonies, and matters involving probate, real estate, and taxation.

Meanwhile, the Volusia County Court tries cases involving civil claims worth less than $50,000, along with misdemeanors and traffic infractions. You can conduct a Volusia County case search through the county’s Clerk of the Circuit Court.17 This office is the county’s public records repository for both the District Court and the County Court.

How To View Volusia County Vital Records (Marriage, Divorce, Birth & Death)

Florida public records involving important life events, including births, marriages, and deaths are considered vital records. You may want to access vital records if you need a copy of your birth certificate for identification purposes or if you want to find out if someone is married, among other examples.

However, keep in mind that government agencies may restrict access to certain vital records. In this section of the resource for finding public records in Volusia County, we’ll explain these restrictions, as well as the most efficient way to track down the information you’re looking for.

Obtain Volusia County Divorce & Marriage Records via Official Channels

The Volusia County Clerk of the Circuit Court maintains marriage records dating back to 1855. Records from April 4, 1988, to the present can be accessed for free using the office’s Document Inquiry tool.18 You can use this tool to search public records kept by the agency by name or instrument number.

To better track down the Volusia County marriage records you’re looking for, it’s recommended that you select the “Open Advances” checkbox. This will allow you to narrow down the search and check if someone is married by selecting “Marriage Certificate” from the “Document Type” drop-down menu.

If you’re looking for Volusia County divorce records, the most efficient way to do so is by using the Clerk of the Circuit Court’s Case Management System. You can select these search options to find divorce information:

  • Case Type: Family Law
  • Case Category: Dissolution of Marriage

You can also use the MyFloridaCounty website to order uncertified paper copies of marriage records online. This service, which is managed by Florida county clerks, offers Volusia County marriage records dating back to April 1988. The cost is $3 per copy, plus shipping and handling (which varies based on the desired shipping method). You can pay with a debit or credit card online.

Another way to order marriage and divorce records dating back to June 6, 1927, is through the Florida Health Department’s Bureau of Vital Statistics.

You can use the Application for Marriage Certificate form or the Application for Florida Dissolution of Marriage Certificate form to request the desired records.19, 20

Access or Request Birth & Death Records in Volusia County Through the Department of Health

If you wish to order a certificate of birth or a certificate of death, you can do so from the Florida Department of Health in Volusia County as long as you’re authorized to do so.21 This office keeps birth records dating back to 1930 and death records dating back to 2009.

You can order a birth certificate copy if you’re one of the following:

  • The registrant (if aged 18 or older)
  • Their parent
  • Their legal guardian
  • A legal representative
  • Someone with a certified court order

If the registrant has passed away, a certificate can also be ordered by:

  • Their spouse
  • Their child
  • Their grandchild
  • Their sibling

Likewise, only the following may order a copy of a death certificate:

  • The registrant’s spouse
  • The registrant’s parent
  • Their child
  • Their grandchild
  • Their sibling
  • Someone with a provable interest in the registrant’s estate
  • Some with proof that they’re acting on behalf of the registrant’s immediate family

Birth certificate copies cost $15, while death certificate copies cost $8. Payment can be made with a money order or check made out to “Florida Department of Health Volusia County.” Use either the Application for Birth Record or the Application for Death Certificate.22

How To Acquire Free Volusia County Property Records

There are three custodians of Volusia County public records related to properties; you can use any or all of them to conduct a free public records search and find out who owns a particular property.

The first custodian is the Volusia County Property Appraiser. This agency’s website allows users to look up property ownership records by name, address, or parcel ID. Using this tool will allow you to see the name and mailing address of the owner of a property, as well as tax appraisal details, information about any permits, and an aerial view of the parcel.

The second agency that allows users to conduct a free search of property records is the Volusia County Tax Collector’s Office. This office’s website features a property search tool you can use by entering a name, address, or parcel number.

Citizens’ Rights & Responsibilities Regarding Volusia County Public Records

The U.S. Freedom of Information Act and Florida’s Public Records Law preserve the right to access many different types of public records. However, with this freedom comes responsibility. You must never use the information gathered during a search of public records to commit a crime, such as identity theft, stalking, or harassment.

The U.S. Fair Credit Reporting Act (FCRA) also forbids conducting a professional background criminal records check — for employee, volunteer, or tenant screenings, licensing, etc. — without the consent of the search subject.
